In the spring of 2017, the Golovan and Partners Law Firm representing the interests of the Isolation Foundation appealed to the Chairman of the National Security and Defense Council of Ukraine, the President of Ukraine Petro Poroshenko and the Secretary of the National Security and Defense Council of Ukraine, Alexander Turchinov, requesting that several of its clients be included in the list of captured enterprises, before the return of which to the functioning in accordance with the legislation of Ukraine, the movement of goods through the contact line ceases.
This decision was prompted by the Decree of the President of Ukraine N62 / 2017 of March 15, 2017, which introduced the decision of the National Security and Defense Council of Ukraine on March 15, 2017 “On urgent additional measures to counter hybrid threats to Ukraine’s national security.”
The purpose of the appeal is to eliminate the discriminatory situation in matters of state protection of the rights of owners of Ukrainian enterprises captured in 2014.
After a series of bureaucratic notices, a response was received from the first deputy secretary of the National Security and Defense Council of Ukraine, Colonel-General Mikhail Koval. According to her, neither the Secretary of the National Security and Defense Council of Ukraine nor the NSDC of Ukraine has information about the list of seized enterprises in the territory of Donetsk and Lugansk regions.
In November, the “Isolation” charitable foundation filed a lawsuit against Petro Poroshenko as the head of the National Security and Defense Council on recognizing this inaction as unlawful and demanding to take action on the list of enterprises seized in the occupied territories. The first meeting on the suit of the CF “Isolation” to the head of the National Security and Defense Council and the President of Ukraine will be held on February 6, 2018.
The future judicial decision should become a kind of marker of how much the result of the reform of the judiciary initiated by the President managed to make it independent of the executive branch. In addition, the further actions of the National Security and Defense Council will be a clear proof of whether the current government plans to turn the trade with DNR and LNR into the next gray zone of this war.
